$15 Million Tower of Terror Lawsuit Against Walt Disney World Dropped

Paperwork was filed earlier today with the comptroller’s office in Orange County, Florida earlier today, which announces that a lawsuit against Walt Disney World by Leanne Deacon, on behalf of her daughter, was voluntarily dismissed with prejudice. This likely indicates that an out-of-court settlement between the parties has been reached.

The lawsuit, which was filed in early 2009, alleges that Deacon’s then-teenage daughter suffered permanent brain damage after collapsing as a result of riding Disney’s Tower of Terror attraction in 2005. Deacon claimed Disney Parks and Resorts was negligent in providing ample warnings about the potential dangers of the attraction and was reportedly seeking in excess of $15 million, an amount Deacon claimed would be necessary to support her daughter for the remainder of her life.

Tower of Terror Joins Disney PhotoPass System at Walt Disney World

Tower of Terror, located in Disney’s Hollywood Studios at the Walt Disney World Resort,, has become the third attraction to allow guests to place their photos directly on the Disney PhotoPass system, according to cast member @BellHopDave (who provides a photo of the options). Like Space Mountain, the ability to add the Tower of Terror photo to PhotoPass requires a paid purchase and it seems to be fairly identical to the Space Mountain options and prices, save for no mention of the USB drive option.

Deacon Follows Suit (and Files Suit) on Tower of Terror

It’s just not a good week for the Twilight Zone Tower of Terror at Disney’s Hollywood Studios. The Orlando Sentinel is reporting that UK residents Leanne Deacon and her mother have filed a lawsuit against Walt Disney World following a 2005 incident in which Deacon suffered from eventual cardiac arrest and a brain hemorrhage which required emergency surgery. The suit, which is claiming unspecified damages exceeding $15,000, claims that Walt Disney World was behaving as a ‘common carrier’ and thus was subjected to specific regulations guaranteeing guests’ safety. The suit also cites that Disney failed to present ample warnings and safety restraints. For it’s part, Walt Disney World conducted a full inspection of the attraction that same evening, even inviting oversight from the Florida Department of Agriculture Bureau of Fair Rides Inspection and found the attraction to be operating successfully. In Florida, amusement parks of a certain size (which includes Walt Disney World) are not regulated by the state. (more…)
